This role will handle complex contract surety claims across the country.
Responsibilities
- Assist with Commercial and Contract Underwriting which includes direct communication with agents, attorneys, and principals: Address questions/concerns re the bond forms, underlying contract obligations, indemnity agreement and/or Collateral Security Agreement and revise the agreements as necessary and appropriate; Draft and revise bond forms to conform to applicable statutes and/or Court orders; Review and revise account control agreements; Review and revise Non-Disclosure Agreements; Prepare Deeds of Trust, Substitutions of Trustee and Full Reconveyances, Lis Pendens, Release of Lis Pendens, Letters of Instruction to Escrow, Declarations, and Affidavits; Assist with securing collateral which includes sending demands to escrow; Oversee and manage premium collection internally and with outside vendors
- Communicate with principals, claimants, agents, consultants, attorneys, reinsures, underwriters, and third parties both verbally and in writing concerning claim, legal, and regulatory matters; Evaluate risk of loss and act to prevent and mitigate loss to the company which includes reserving rights, sending collateral demands, securing assignments; Attend court hearings, mediations, settlement conferences, and trials; Manage and oversee outside counsel during all phases of litigation; Draft, review, and revise settlement agreements, releases, tolling agreements, stipulations and orders; Recommend and monitor case reserves, LAE reserves, and anticipated salvage reserves. Oversee application of payments and recoveries to applicable reserves; Provide periodic status reports to management and reinsurers as necessary
- Handle subrogation of losses/indemnity collection on contract bond matters and oversee and manage outside counsel during all phases of indemnity actions
- Monitor contract matters that may turn into claims
- Respond to Subpoenas regarding Contract Bond Matters
- Oversee and supervise Claims Administrators
Education
- Bachelor’s degree or equivalent work experience
- Juris Doctorate Preferred
Work Experience
- Minimum of 10 years' experience in Surety Claims
- Knowledge of Surety Construction industry and bonds
